In consideration of ATL Hawks, LLC (“Hawks”) and/or Atlanta Hawks Management, LLC, Atlanta Hawks, L.P., Arena Operations, LLC d/b/a State Farm Arena, Arena Sports Marketing, LLC, Hawks Player Development Facility, LLC, Hawks Gaming, LLC d/b/a Hawks Talon GC, Hawks Sustainability, LLC, Skyhawks Holdings, LLC, CMWM, LLC d/b/a College Park Skyhawks, and Atlanta Hawks Foundation, Inc. (collectively, the “Hawks Entities”) allowing me and, if applicable, the underage participant (the “Minor”) who I am the legal guardian of, to voluntarily participate in certain promotional activities and/or the use of equipment and facilities in connection therewith (collectively, the “Activities”), I HEREBY ACKNOWLEDGE AND AGREE THAT MY AND/OR MINOR’S PARTICIPATION IN SUCH ACTIVITIES INVOLVES RISK OF BODILY INJURY, DEATH AND/OR DAMAGE TO OR LOSS OF PROPERTY AND I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN ON BEHALF OF MYSELF AND/OR MINOR. I hereby release and hold harmless the Hawks Entities, the National Basketball Association (“NBA”) and its Member Teams, the NBA Development League, LLC and its affiliates and teams, NBA 2K League, LLC and its Member Teams, NBA Media Ventures, LLC, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents (“NBA Entities”), State Farm Mutual Automobile Insurance Company, City of Atlanta, Fulton County and City of Atlanta and Fulton County Recreation Authority, Emory Healthcare, Inc., City of Brookhaven, Brookhaven Development Authority, College Park Business and Industrial Development Authority, City of College Park, Georgia and/or its affiliates and each of their respective parent, subsidiary and affiliated companies, and all of their respective directors, officers, shareholders, employees, agents, consultants, volunteers, independent contractors (including, but not limited to, concessionaires and parking operators), sponsors, successors and assigns (collectively, the “Indemnified Parties”), from any and all rights, claims, demands, losses, damages, expenses, costs and actions (including reasonable attorneys’ fees) to me, Minor, or my and/or Minor’s property, whether arising from, without limitation, the negligence of the Indemnified Parties or otherwise, which I, Minor, my and/or Minor’s heirs, executors or assigns may have in connection with my and/or Minor’s voluntary participation in the Activities or use of any facilities or services in connection therewith, including without limitation, any bodily injuries, death, personal injuries or property damage that I and/or Minor may incur or which may arise or result from my and/or Minor’s voluntary participation in the Activities. I acknowledge that my and/or Minor’s participation in the Activities shall be subject to the rules and regulations that the Indemnified Parties may require and that I shall be obligated to pay for any damage that I and/or Minor may cause while participating in the Activities.
I and/or Minor hereby acknowledge and agree to adhere to all health and safety requirements and policies put in place by the Indemnified Parties and any state, provincial, local or other governmental rules and regulations, including any requirements related to the use of facemasks and/or enhanced health screenings (which may include a requirement that I and/or Minor be tested for and/or vaccinated for COVID-19 prior to entering the facility or such other location that the Activities may be held), including but not limited to an NBA Entity mandate that anyone participating in Activities must show proof of COVID-19 vaccination (actual card, photo, or CLEAR app) upon arrival at the location that the Activities may be held. This section is an acknowledgement and express assumption of risk and release of liability in any way related to me and/or Minor being exposed to or contracting COVID 19 or any other communicable or infectious diseases, viruses, bacteria or illnesses or the causes thereof, during or in connection with my and/or Minor’s participation in the Activities and/or presence at the Activities.
Further, I hereby grant the Indemnified Parties and/or their sponsors, the perpetual, worldwide right to make both visual and audio recordings and still images of me and/or Minor and to use my and/or Minor’s name, image, voice, likeness, picture, words, identity, testimonials, and biographical information or any material based on or derived therefrom of me and/or Minor in connection with any of the Activities in any of the Hawks games, Hawks-related programming, promotional/marketing materials, community affairs initiatives and/or any and all media, whether now known or hereafter developed for the purpose of advertising, marketing and/or promoting the Hawks Entities and/or their sponsors. I agree that the rights granted hereunder shall include the perpetual, worldwide right of the Hawks Entities and/or their sponsors to edit, telecast, cablecast, rerun, record, publish, reproduce, use, license, print, distribute or otherwise exploit my and/or Minor’s name, image, voice, likeness, and biographical information in any manner and in any medium or forum whether now known or hereafter devised, in whole or in part, without any further compensation to me and/or Minor.
I have read this entire document and acknowledge, accept, and assume the risk that injury or damage to my person and/or Minor or property may result from such Activities and warrant that I am over eighteen (18) years of age and that I have every right to contract in my own name and/or on behalf of Minor.
